Terms of Sales - How does our online sale work?

1 – Preamble :

These conditions of sale are concluded on the one hand between the sole proprietorship « Façon papier » represented by Marie-Pierre Braud whose postal address is indicated at the end, and on the other hand, by any natural or legal person wishing to make a purchase. via the faconpapier.com website hereinafter referred to as "the buyer" whether professional or private.

2 – Object :

The acquisition of a good or a service through this site implies unreserved acceptance by the purchaser of the general conditions of sale which shall prevail over all other general or particular conditions not expressly approved by « Façon papier ».

« Façon papier » reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.

3 – Characteristics of the goods and services offered :

The products and services offered are those which appear in the catalog published on the “faconpapier.com” site. These products and services are offered for sale within the limits of available stocks.

Each product is accompanied by the description established by the supplier.

The photographs in the catalog are as accurate as possible but not contractual.

4 – Prices :

The prices appearing in the catalog are net prices in euros. « Façon papier » reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the purchaser.

The prices indicated do not include the costs of order processing, transport and delivery as long as they take place in the geographical areas provided for in Article 5.

5 – Geographical area :

The online sale of the products and services presented on the site is reserved for buyers who reside in the countries mentioned in Delivery, and for deliveries required in these geographical areas.

6 – Orders :

The buyer who wishes to buy a product or a service must:

- complete the identification form on which he will indicate all the requested contact details,

- complete the online order form,

- validate his order after checking his basket,

- make the payment under the conditions provided,

- confirm their order and payment.

Confirmation of the order implies acceptance of these general conditions of sale.

All the data provided and the recorded confirmation will constitute proof of the transaction.

The seller will communicate by email confirmation of the recorded order.

7 – Rétractation :

Buyers, non-professional natural persons, benefit from a withdrawal period of 14 days from the delivery of their order to return the product to the seller for exchange or refund without penalty with the exception of the return costs which remain at the buyer's responsibility.

The customer will return the refused product in its original packaging, which has not been opened, within the legal period of 14 days stipulated above.

It will only be refunded or exchanged for products which have been returned within the framework of the withdrawal and which can again be offered for sale.

The risks associated with returning the item (loss or damage) remain the responsibility of the customer.

Under no circumstances can the return of the product be made on its own initiative. The customer will first contact "L’Arcade de Gutenberg" and will be issued a return number.

8 – Refund:

When the customer uses his right of withdrawal, the seller has 30 days to make a refund.

Refunds in the form of vouchers or credit notes are not accepted. Consult us if necessary.

9 – Method of payment :

The price is payable when ordering. Payments can be made by credit card (through the secure payment system Paypal), by check.

The buyer's account will only be debited for the amount of products or services sent or downloaded.

An electronic invoice will systematically be sent to the buyer. The invoices of « Façon papier »", by virtue of its VAT-exempt status, will bear the mention "VAT not applicable, article 293B of the CGI".

10 – Order execution :

Upon receipt of payment.

Delivery times are 48 hours on average excluding weekends and holidays, D + 1 shipping.

11 – Deliveries :

Deliveries are made to the address indicated in the order form and in accordance with paragraph 5, which can only be in the agreed geographical areas.

In the event of damage during transport, the reasoned protest must be formulated by mail to the carrier within 3 days of delivery.

12 – Guarantee :

All products supplied by the seller benefit from a legal guarantee provided for by articles 1641 and following of the Civil Code.

In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it, reimburse it or offer a similar item in the event of out of stock. The cost of shipping the new item will be borne by the seller.

All complaints, requests for exchanges or refunds must be made by e-mail through the "contact" link made available to the customer on the site.

13 – Responsibility :

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, interruption of service, or other unintentional problems not falling under its responsibility.14 – Archivage – Preuve :

« Façon papier » will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

The computerized records of « Façon papier » will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

15 - Protection of personal data :

In accordance with Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free movement of such data, faconpaper.com sets up a processing of personal data which has for the purpose of selling and delivering the products and services defined in this contract.

The seller is informed of the following:

- the identity and contact details of the controller and, where applicable, of the representative of the controller: Façon papier , as indicated at the top of these T & Cs;

- the contact details of the data protection officer: Façon papier 

- the legal basis of the processing: contractual performance

- the recipients or the categories of recipients of personal data, if they exist: the controller, his departments in charge of marketing, the departments in charge of IT security, the department in charge of sales, delivery and ordering, subcontractors involved in delivery and sales operations as well as any authority legally authorized to access the personal data in question

- no transfer outside the EU is planned

- the data retention period: the time of the commercial prescription

- the data subject has the right to request from the controller access to personal data, the rectification or erasure of these, or a limitation of the processing relating to the data subject, or the right to oppose the processing and the right to data portability

- The data subject has the right to lodge a complaint with a supervisory authority

- the information requested during the order is necessary for the establishment of the invoice (legal obligation) and the delivery of the goods ordered, otherwise the order cannot be placed. No automated decision-making or profiling is implemented through the ordering process.

Applicable law and clauses

All the clauses appearing in these general conditions of sale, as well as all the purchase and sale transactions referred to therein, will be subject to French law.

The nullity of a contractual clause does not entail the nullity of these general conditions of sale.

Consumer information

For consumer information purposes, the provisions of the Civil Code and the Consumer Code are reproduced below:

Aricle 1641 of the Civil Code: The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have it acquired, or would have given only a lower price, if he had known them.

Aricle 1648 of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect. In the case provided for by article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller can be released from apparent defects or lack of conformity.

Article L. 217-4 of the Consumer Code: The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, assembly instructions or installation when this has been charged to it by the contract or has been carried out under its responsibility.

Article L. 217-5 of the Consumer Code: The goods comply with the contract:

1 ° If it is suitable for the use usually expected of a similar good and, if applicable:

- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

- if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;

2 ° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L. 217-12 of the Consumer Code: The action resulting from the lack of conformity lapses two years after delivery of the goods.

Article L. 217-16 of the Consumer Code: When the buyer asks the seller, during the course of the commercial guarantee granted to him during the acquisition or repair of movable property, condition covered by the warranty, any downtime of at least seven days is added to the remaining warranty period.

This period runs from the buyer's request for intervention or the provision for repair of the property in question, if this provision is subsequent to the request for intervention.

16 – Litigation :

These conditions of online sale are subject to French law.

In the event of a dispute, jurisdiction is assigned to the competent courts of Puy en Velay (Haute-Loire).
